HBB heading to court in Calgary Expo case

UPDATE

Hi all, thanks again for your efforts in making sure we got to our hearing. Good news and bad news.

The good news is that a judge found all of our causes of action had merit, which means the Calgary Expo and The Mary Sue’s application for summary dismissal was denied.

Unfortunately due to the extended conversation over semantics and technicalities by the time the summary judgement was declined, we had half a day left for trial.

The judge who presided over the summary judgement was the first judge to take an in depth look at the case and due to the complexity and scope he informed us that at least two and more likely three days would be needed.

We were granted November 28th-30th, 2017 for our official trial dates. We look forward to our next day in court.

On April 16, 2015, Alison Tieman and the Honey Badger Brigade opened a booth at the Calgary Comic & Entertainment Expo. The booth, which bore the group’s name, contained a combination of HBB merchandise and editions and merchandise from Alison’s Xenospora comic. Included in the booth was an anti-censorship banner with the gamergate logo on it as a tribute to gamergate supporters who had donated to our fundraiser to help get us to the expo.

The next morning, the expo expelled Alison and the Brigade, defaming her and the Brigade with false accusations of disruptive conduct to rationalize its decision to censor the group’s views. These accusations included some claims published in a Mary Sue article and subsequently promoted by the expo as the reason behind the expulsion. Those accusations were repeated, and that article cited, by various media sources following the incident.

In response, the Brigade has pursued legal action in the Provincial Court of Alberta against Calgary Expo for Injurious Falsehood and Breach of Contract and the Mary Sue for Injurious Falsehood and Incitement to Breach of Contract. The relevant court documents are publicly available.

The defendants have tried and failed to get the suit thrown out prior to any hearing. Calgary Expo attempted to use a maze of vaguely associated legal entities as a cover to avoid the suit. The court has rejected these tactics, and the date of the hearing will be January 12th, 2017. The defendants are asking for a summary dismissal, which will be considered on the court date before any further legal considerations.
